Collective Actions

Founding partner David Lichter is currently co-lead counsel in a banking overdraft collective action against BankAtlantic (now BB&T) pending in state circuit court and was involved in the multidistrict banking litigation in Miami in federal court. He is also co-lead counsel in the Agwuh, et al v. Darden Restaurants arbitration actions pending before the American Arbitration Association. This is a collection of more than 3,500 wage and hour arbitration demands filed against the world’s largest full-service restaurant group. Read More

David Lichter anchors the firm's alternative dispute resolution services. Mr. Lichter has mediated and arbitrated more than 1,500 matters pre-suit, pending in state and federal district and bankruptcy courts, the American Arbitration Association and before the Financial Industry Regulatory Authority. Mr. Lichter regularly travels throughout Florida, around the country and has traveled to Puerto Rico and the Bahamas to mediate and arbitrate matters.

He has extensive experience litigating and mediating matters involving restrictive covenants, covenants not to compete, confidentiality, sale of a business under Sections 542.33 and 542.335 of the Florida statutes, collective actions and wage and hour matters and theft or misappropriation of trade secrets under Section 688 of the Florida statutes, including injunctive relief.     David H. Lichter is an experienced litigator whose work is substantially devoted to mediating, arbitrating and litigating business and intellectual property disputes, wage and hour matters and collective actions. Mr. Lichter has mediated and arbitrated more than 1600 matters, is engaged regularly by plaintiffs and defendants and mediates and arbitrates cases throughout the United States and abroad. He is A/V rated by Martindale‐Hubbell®, the highest available rating, and is included in the 2017 edition of The Best Lawyers in America® in the specialty of Mediation and Arbitration, the 2016 edition of Florida Super Lawyers® in the area of Alternative Dispute Resolution (Top 100 lawyer) and the 2011 Florida Trend magazine’s Florida Legal Elite® in the field of mediation.
  • Mayra Lichter

    Mayra’s practice focuses on Wage and Hour litigation and issues relating to non-profit organizations. Mayra also has substantial experience in appellate matters. Mayra received her B.A. from Brown University Magna Cum Laude in 1980 and her J.D. from the University of Florida with honors in 1983. At the University of Florida, she served on the Moot Court Board, was a legal research and writing fellow, and won Best Oral Advocate at the Justice Campbell Thornall Moot Court Competition.
  • Brianne Duffy

    Brianne Duffy received her Juris Doctor from Boston University School of Law in 2015 and received her Bachelor of Arts degree in English, summa cum laude, from Florida International University in 2012. While attending Boston University School of Law, Ms. Duffy represented Boston residents in employment cases as a certified student attorney with the Boston University Employment Rights Clinic. She also worked at the U.S. District Court for the District of Massachusetts as a judicial extern to U.S. Magistrate Judge Judith G. Dein. Brianne is a member of the Florida Bar.
  • Janessa Wasserman, Of Counsel

    Janessa’s practice currently focuses exclusively on Wage and Hour matters. Janessa also has substantial experience in intellectual property rights enforcement and piracy, as well as complex commercial litigation, antitrust and trade regulation and tax matters. Janessa received her Bachelor of Arts degree in English Literature from the University of Miami in 1995. In 1998, Janessa received her J.D. degree from the University of Miami School of Law, where she was the Writing and Research Editor of the Yearbook of International Law and was involved in the Litigation Skills Program. Janessa is a member of the Florida Bar and American Bar Associations. Janessa is certified by the Florida Supreme Court as a Certified Civil Circuit and County Court mediator.
